Terms and Conditions of Jewefy

Eligibility to Use the Services

By agreeing to this document, you acknowledge and confirm the following:

1. You have not been previously banned from using Jewefy services or prohibited from accessing them at any time for any reason.
2. You are not a competitor of Jewefy and do not offer any product competing with the services provided by Jewefy.
3. You have the full power and authority to enter into this agreement without violating any laws or agreements.

Commitments and Warranties

You confirm and warrant that you will:

1. Comply with all applicable laws and regulations in the UAE, with any violations being your sole responsibility without legal accountability on Jewefy.
2. Review and comply with any notices sent by Jewefy or mentioned on Jewefy platforms regarding your use of Jewefy services.
3. Not sublicense, publish, transfer, distribute, perform, display, sell, or commercially exploit Jewefy services except as permitted under this agreement.
4. Not disrupt the proper operation of Jewefy or exploit any system vulnerabilities.
5. Not attempt to harm the service in any way.
6. Keep your account password or any access credentials provided by Jewefy secure and confidential.
7. Provide evidence of your identity as deemed necessary by Jewefy.
8. Immediately report any unauthorized use of your account or other security breaches to Jewefy.
9. Not modify or tamper with any part of the system or services in any way.
10. Not use the system to transmit or distribute viruses or malicious software.
11. Not collect or store personal data of other users without their explicit consent.
12. Not bypass any security measures or access restrictions of the system.
13. Jewefy reserves the right to refuse, suspend, or terminate service without providing reasons.

License Scope

Jewefy grants you a non-exclusive, non-transferable, non-assignable, non-sublicensable, and revocable license to use its services for the specified personal purposes under this agreement. You must:

1. Not make the services available to, rent, lease, assign, resell, distribute, or sublicense to any third party.
2. Not modify, decompile, or reverse-engineer the Jewefy system or attempt to access its source code or internal design.
3. Not delete or alter any copyright or official notices included in the services.
4. Not intentionally share services with unauthorized persons or entities.
5. Not share your username, password, or other access credentials with anyone else.
6. Not use the services for any illegal or unauthorized purpose.
7. Not interfere with the proper operation of the services or bypass any security measures.
8. Not use automated tools to collect information from Jewefy services without prior written permission.
9. Not upload or transmit any materials containing viruses or malware through the services.
10. Not use the services to send spam or unauthorized promotional messages.

Intellectual Property Rights

All intellectual property rights for these services and all related materials or those appearing on them (including any content you provide or include) are the exclusive property of Jewefy. You must not reproduce or allow anyone else – for any reason – to use or reproduce the services or any trademarks or trade names that appear in the services and comply with all laws and regulations related to intellectual property rights protection.

Payment

1. Jewefy reserves the right to impose new fees for using the service. If Jewefy decides to introduce new fees, you will be notified and given the option to continue the contract or terminate it.
2. Jewefy may modify or update prices from time to time. It is your responsibility to stay informed about the current prices for the provided services, which can be accessed from the homepage of the Jewefy platform.
3. You must pay for the services to Jewefy via bank transfers or any other method imposed by the Jewefy platform as soon as the service is provided to you. You alone are responsible for paying all fees on time and acknowledge that any paid amount is non-refundable.
4. By agreeing to these terms of use, you agree that your access to the saved data in the Jewefy system is contingent on your account being active and your subscription being paid. Failure to pay the due amounts will result in the suspension of your access to the service and the saved data.
5. Reminders and periodic notifications regarding payment deadlines and due amounts will be sent to you via email or text messages.
6. If you fail to pay the due subscription fee in the Jewefy system, Jewefy grants you a grace period of up to seven days before suspending your access to the service and the saved data. Jewefy is not responsible for preserving the data after this period. This grace period will be invoiced by Jewefy, and you must pay for it.
7. A specific refund policy may be provided in exceptional cases, at Jewefy's sole discretion based on the nature of the issue.

Indemnification

By agreeing to these terms of use and using the service, you agree to defend Jewefy and its affiliates, licensors, officers, directors, other users, employees, attorneys, and agents, and hold them harmless from any claims, costs, damages, losses, liabilities, and expenses (including attorney fees and costs) arising out of or related to:

1. Your violation or breach of any term of these terms of use or any applicable law or regulation, whether referenced in these terms or not.
2. Your violation of any rights of a third party, including service providers regulated by the Jewefy service.
3. Your commitment to indemnify Jewefy and concerned parties for any losses or damages resulting from unauthorized use of the service or unauthorized modifications or additions to the system.
4. Your responsibility for any claims by third parties due to the violation of their rights from content published or transmitted through the Jewefy service using your account.
5. Exempting Jewefy and related parties from any claims or liabilities arising from your use of the service in a manner inconsistent with local or international laws.

Legal Liability

1. The information, recommendations, services, or any of them provided to you on or through the website and service are for general informational purposes only and do not constitute advice. Jewefy will strive to keep the website, service, and content accurate and updated, but it does not guarantee that the (contents) of the website or service are free from errors, defects, malware, or viruses, nor does it guarantee the accuracy, reliability, or timeliness of the website or service.
2. Jewefy is not liable for any damages resulting from using (or inability to use) the website or service, including damages caused by malware or viruses, nor is it liable for inaccuracies or incompleteness of the information, website, or service unless such damage is due to intentional misconduct or gross negligence by Jewefy.
3. Jewefy is also not responsible for any damages arising from using (or inability to use) electronic communication means with the website or service, including – but not limited to – damages caused by non-delivery or delayed delivery of electronic communications, interception, or manipulation of electronic communications by third parties or computer programs used for electronic communications and virus transmission.
4. Jewefy will strive to provide its electronic services 24/7 throughout the year, but it does not guarantee uninterrupted operation of the Jewefy system year-round. There will be downtimes for maintenance, periodic updates, or the addition of new features to the service.

Service Modification

Jewefy reserves the right, at its sole discretion, to do the following at any time:

1. Modify the services or any related materials and/or cease publishing the services after prior notification to users, except in emergencies requiring immediate action.
2. In the event Jewefy decides to discontinue publishing the services, it may, at its discretion, replace the services with similar materials without any compensation obligations to users or third parties.
3. Is not responsible for any losses or damages resulting from changes to the services or their discontinuation, whether as compensation to users or any other affected party.
4. Jewefy reserves the right to take legal action if the services are used in a manner that violates the terms and conditions stipulated herein.
5. Existing users must regularly review the terms and conditions, and continued use of the services constitutes acceptance of any future changes to the terms and conditions.

Limitation of Liability

Jewefy provides no warranties, explicit or implicit, regarding the services, all of which are offered “as is.” Jewefy expressly disclaims all warranties to the maximum extent permitted by law, including but not limited to: warranties of fitness for a particular purpose, suitability for specific standards and markets, and merchantability. Furthermore, Jewefy does not guarantee the accuracy, content, or timeliness of the services or the outcomes users may achieve from them. Jewefy, its agents, licensors, or affiliates will not be held liable for any direct or indirect damages, penalties, special damages, incidental damages, or consequential damages. This includes, but is not limited to, losses due to profit loss, business interruptions, or the loss of business data arising directly or indirectly from access to or use of the services (or failure to use them) or reliance on them.

In all cases, by agreeing to these user terms, you acknowledge that Jewefy's responsibility for data retention is limited to a maximum of one month after the subscription ends, after which Jewefy has the right to delete this data entirely from its service and dispose of it in a manner deemed appropriate by Jewefy.

Security

You acknowledge and agree to the following:

1. You bear full and sole responsibility for the privacy of your account and for the use of the services with your account, username, password, or access information by any other person.
2. You must notify Jewefy immediately in case of any loss, theft, or unauthorized use of any password, username, IP address, or any other means of accessing the services.
3. You agree to indemnify Jewefy, its affiliates, licensors, employees, and agents against any claims, losses, damages, or costs arising from unauthorized use of your account, username, password, or access information.
4. You must take appropriate security measures to protect your account and access information, including choosing strong passwords and not sharing them with others.
5. Jewefy reserves the right to take security measures or restrict access to your account in case of suspected unauthorized use.

Contract Duration and Termination

The contract between you and Jewefy is indefinite. You have the right to terminate the contract by closing your user account at any time. Jewefy has the right to terminate the contract immediately at any time (by disabling your use of the service) in the event of a violation of any applicable rules and regulations within the Jewefy platform.

Invalidity of One or More Clauses

The invalidity of any clause of these user terms does not affect the validity of the remaining clauses. If any clause of these user terms is found invalid or deemed unacceptable in certain circumstances according to standards of reasonableness and fairness, it shall be replaced by a valid clause that aligns with the content and purpose of the invalid clause as much as possible.

Modification of Service and User Terms

Jewefy reserves the right, at its sole discretion, to modify any clause of these user terms or replace it, or change, suspend, or discontinue the service (including, but not limited to, providing any feature, database, or content) at any time by posting a notice on the website, sending you a notification through the service, or via email. Jewefy may also impose limitations on certain features or services or restrict access to parts of the service or the entire service without notice or liability.

Notifications

Jewefy may send notifications via a general notice on the service, an email to your registered email address in the Jewefy account information, a letter sent by regular mail to your registered address, or via text messages.

Governing Law and Dispute Resolution

These user terms are governed by and construed in accordance with the laws and regulations of the United Arab Emirates and apply to resolving any disputes, claims, or disagreements arising from or related to these user terms, including their violation, termination, enforcement, interpretation, validity, or use of the website or service.
